Following the refusal of planning permission due to the loss of ancient woodland arising from a proposed boardwalk and access road for residential development, we advised on solutions to minimise the impact to ancient woodland. This included the design of the boardwalk and the detailed design of the proposed access road, to minimise harm to ancient woodland. This served to lower the bar of harm to ancient woodland which the need for and benefits of the scheme needed to exceed to meet the NPPF test. The Inspector concluded that the test was met, and the appeal was allowed.
